مالكة الموقع ونطاق الشروط
يُدار هذا الموقع بواسطة ملاك منصور (Malak Manzour). تنظّم هذه الشروط استخدام الموقع وشراء المنتجات الملموسة أو الرقمية المعروضة من خلاله، بما في ذلك دفتر يوميات «أنا هيَ»، وشراء كورس فكّ الشيفرة | تحرّر الذات، بالإضافة إلى تقديم طلبات حجز ساعة الاستشارة والخدمات المرتبطة بها.
قبول الشروط
يخضع استخدام الموقع لهذه الشروط والسياسات المرتبطة بها. وعند إتمام عملية شراء أو تقديم طلب حجز بعد إتاحة هذه الشروط لكِ، فإنكِ تقرّين بأنكِ اطلعتِ عليها وتوافقين على تطبيقها على معاملتك، مع بقاء أي حقوق إلزامية يمنحها لكِ القانون سارية دون انتقاص.
الأهلية
المشتريات والحجوزات من خلال الموقع مخصصة لمن تتمتع بالأهلية القانونية اللازمة لإبرام الصفقة المعنية. عند تقديم طلب أو حجز، تقع عليكِ مسؤولية تقديم بيانات صحيحة ومحدثة وعدم استخدام بيانات أو وسيلة دفع لا يحق لكِ استخدامها.
استخدام الموقع ومحتواه
يمكنكِ استخدام الموقع ومحتواه المتاح لكِ بصورة قانونية ولأغراض شخصية وغير تجارية. لا يمنحك استخدام الموقع أو شراء منتج أو كورس أي ملكية في الموقع أو محتواه، ولا أي حقوق تتجاوز حق استخدام ما تم توفيره لكِ وفق طبيعة المنتج أو الخدمة وهذه الشروط.
الاستخدام المسموح والممنوع
يُمنع استخدام الموقع بصورة غير قانونية أو مضللة، أو محاولة اختراقه أو تعطيله أو تجاوز وسائل الحماية فيه، أو انتحال شخصية أخرى، أو نسخ أو نشر أو مشاركة أو إعادة بيع محتوى مدفوع أو مواد الكورس أو المنتجات الرقمية دون إذن مناسب. ولا يقيّد هذا البند أي استخدام يسمح به القانون صراحةً، بما في ذلك الاستثناءات القانونية المتعلقة بحقوق المؤلف.
المنتجات والخدمات والطلبات والأسعار
قد يعرض الموقع منتجات ملموسة أو رقمية، بما فيها دفتر يوميات «أنا هيَ»، وكورس فكّ الشيفرة | تحرّر الذات، وخدمة حجز ساعة استشارة. نبذل جهدًا معقولًا لعرض الأوصاف والأسعار بصورة واضحة ودقيقة. الأسعار المعروضة بالشيكل الجديد (₪ / ILS) تشمل ضريبة القيمة المضافة إذا كانت واجبة التطبيق، وتُعرض أي تكاليف إضافية واجبة على الطلب، مثل الشحن إن وجدت، قبل إتمام الشراء. يُعتبر شراء المنتج أو الكورس مؤكدًا بعد إتمام عملية الدفع وقبول الطلب، أما إرسال طلب استشارة فلا يعني تأكيد الموعد؛ يخضع الطلب لموافقة المدربة، ويتم دفع ثمن الاستشارة دائمًا خارج الموقع بعد الموافقة. إذا تعذر تنفيذ طلب مدفوع تم قبوله، فسيتم التعامل مع المبلغ المدفوع وفق القانون والسياسة المطبقة.
التسليم والإلغاء والإرجاع والاسترداد
يتم توفير المنتجات الرقمية والكورس بالطريقة الموضحة عند الشراء، وتُسلّم المنتجات الملموسة وفق طريقة التسليم أو الشحن المتفق عليها. وتخضع حقوق الإلغاء والإرجاع والاسترداد لجميع المنتجات والكورس وطلبات وحجوزات الاستشارة لـسياسة الإلغاء والإرجاع والاسترداد المنشورة على الموقع، والتي تشكل جزءًا من هذه الشروط. وتنطبق تلك السياسة على الاستشارة حتى عندما يتم دفع ثمنها خارج الموقع متى كان طلب الحجز قد تم من خلال الموقع؛ ولا يعني إلغاء موعد الاستشارة تلقائيًا استرداد المبلغ أو الحصول على موعد بديل دون رسوم، وأي موعد جديد يُعامل كحجز جديد، إلا إذا كان القانون يوجب خلاف ذلك أو وافقت المدربة صراحةً على استثناء.
الملكية الفكرية
حقوق الملكية الفكرية المتعلقة بالموقع ومحتواه، بما في ذلك النصوص والتصاميم والصور والمواد التعليمية ومحتوى الكورس ومحتوى دفتر اليوميات والمنتجات الرقمية، تعود إلى ملاك منصور أو إلى أصحاب الحقوق الذين أتاحوا استخدامها، بحسب الحالة. شراء أي محتوى لا ينقل ملكيته الفكرية إليكِ، وإنما يمنحك حق استخدام النسخة أو الوصول المقدم لكِ للاستخدام الشخصي وفق طبيعة المنتج. لا يجوز نسخ المحتوى المحمي أو نشره أو توزيعه أو بيعه أو إتاحته للآخرين دون إذن، باستثناء ما يسمح به القانون.
خدمات وروابط أطراف ثالثة
قد يعتمد الموقع على خدمات خارجية مثل الاستضافة والدفع والتواصل والشحن أو توفير بعض الوظائف التقنية، وقد يتضمن روابط إلى مواقع أو خدمات أخرى. تخضع علاقتك المباشرة بهذه الجهات لشروطها وسياسات الخصوصية الخاصة بها حيث ينطبق ذلك. لا نتحكم في خدمات الأطراف الثالثة، لكن الاستعانة بها لا تنتقص من أي التزام قانوني يقع على ملاك منصور بصفتها بائعة المنتج أو مقدمة الخدمة.

يجوز تحديث الموقع أو تعديل المحتوى المتاح فيه أو إضافة منتجات وخدمات أو إيقاف عرضها. لن يُطبّق أي تغيير بأثر رجعي بطريقة تنتقص من منتج أو خدمة تم شراؤها بالفعل أو من حق قانوني إلزامي. وإذا تعذر توفير طلب مدفوع سبق قبوله، فسيتم تقديم الحل المناسب، بما في ذلك الاسترداد عندما يكون مستحقًا.
تعليق الوصول أو إنهاؤه
يجوز تعليق أو إنهاء الوصول إلى الموقع أو إلى محتوى مقيّد عندما يكون ذلك ضروريًا بصورة معقولة بسبب استخدام غير قانوني، أو احتيال، أو محاولة للإضرار بالموقع أو أمنه، أو مشاركة غير مصرح بها لمحتوى مدفوع أو بيانات وصول، أو مخالفة جوهرية لهذه الشروط. يتم ذلك بصورة متناسبة مع المخالفة ودون الانتقاص من حقوقك القانونية الإلزامية.

حدود المسؤولية
إلى الحد الذي يسمح به القانون، لا نتحمل المسؤولية عن أضرار غير مباشرة أو تبعية تنشأ فقط عن تعطل مؤقت للموقع أو عن ظروف تقنية خارجة بصورة معقولة عن سيطرتنا. لا يستبعد هذا البند ولا يقيّد أي مسؤولية أو تعويض لا يجوز استبعاده أو تقييده بموجب القانون، ولا يؤثر على حقوقك القانونية المتعلقة بمنتج أو خدمة تم شراؤها.

يتم جمع البيانات الشخصية واستخدامها ومشاركتها والاحتفاظ بها وفق سياسة الخصوصية المنشورة على الموقع، والتي توضح أيضًا حقوقك المتعلقة ببياناتك وطرق التواصل معنا بشأنها.
تعديلات على هذه الشروط
قد يتم تحديث هذه الشروط من وقت لآخر لتعكس تغييرات في الموقع أو المنتجات أو الخدمات أو المتطلبات القانونية. تسري النسخة المحدثة من تاريخ نشرها على الاستخدام والمعاملات اللاحقة، أما الصفقة التي تم إبرامها بالفعل فتظل خاضعة للشروط التي كانت سارية عليها عند إبرامها، ما لم يقتضِ القانون خلاف ذلك أو يتم الاتفاق على تعديل صالح قانونًا.

أحكام عامة
إذا تبيّن أن حكمًا من هذه الشروط غير صالح أو غير قابل للتنفيذ، فيُفسّر أو يُعدّل بالقدر اللازم لجعله صالحًا حيث يسمح القانون، وتبقى الأحكام الأخرى سارية. عدم ممارسة حق أو تأخرنا في ممارسته لا يُعد تنازلًا عنه. وتُقرأ هذه الشروط مع سياسة الخصوصية وسياسة الإلغاء والإرجاع والاسترداد وأي معلومات خاصة بالمنتج أو الخدمة يتم عرضها لكِ عند إتمام المعاملة.

האתר עשוי להציע מוצרים פיזיים או דיגיטליים, לרבות יומן ANA HIYA, את הקורס “פענוח הצופן | שחרור העצמי”, ושירות של הזמנת פגישת ייעוץ בת שעה. אנו עושים מאמץ סביר להציג תיאורים ומחירים בצורה ברורה ומדויקת. המחירים המוצגים בשקלים חדשים (₪ / ILS) כוללים מע”מ ככל שהוא חל, וכל עלות נוספת החלה על ההזמנה, כגון משלוח אם ישנו, תוצג לפני השלמת הרכישה. רכישת מוצר או קורס מאושרת לאחר השלמת התשלום וקבלת ההזמנה; שליחת בקשה לפגישת ייעוץ אינה מהווה אישור של המועד. הבקשה כפופה לאישור המאמנת, והתשלום עבור הייעוץ מתבצע תמיד מחוץ לאתר לאחר האישור. אם לא ניתן לספק הזמנה ששולמה ואושרה, הסכום ששולם יטופל בהתאם לדין ולמדיניות החלה.
אספקה, ביטול, החזרה והחזר כספי
מוצרים דיגיטליים והקורס יסופקו בדרך המוצגת בעת הרכישה, ומוצרים פיזיים יסופקו בהתאם לאופן המשלוח או המסירה שסוכם. זכויות הביטול, ההחזרה וההחזר הכספי לגבי כל המוצרים, הקורס ובקשות או הזמנות לפגישת ייעוץ כפופות למדיניות הביטול, ההחזרה וההחזר הכספי המפורסמת באתר ומהווה חלק מתנאים אלה. המדיניות חלה גם על פגישת ייעוץ ששולמה מחוץ לאתר כאשר בקשת ההזמנה נעשתה באמצעות האתר. ביטול פגישת ייעוץ אינו מקנה באופן אוטומטי החזר כספי או פגישה חלופית ללא תשלום, ומועד חדש נחשב להזמנה חדשה, אלא אם הדין מחייב אחרת או שהמאמנת אישרה במפורש חריג.
קניין רוחני
זכויות הקניין הרוחני באתר ובתכניו, לרבות טקסטים, עיצובים, תמונות, חומרי לימוד, תוכן הקורס, תוכן היומן ומוצרים דיגיטליים, שייכות ל-Malak Manzour או לבעלי זכויות שהתירו את השימוש בהם, לפי העניין. רכישת תוכן אינה מעבירה אלייך את זכויות הקניין הרוחני בו, אלא מעניקה לך זכות להשתמש בעותק או בגישה שנמסרו לך לשימוש אישי בהתאם לאופי המוצר. אין להעתיק, לפרסם, להפיץ, למכור או להעמיד תוכן מוגן לרשות אחרים ללא אישור, למעט ככל שהדין מתיר.

Acceptance of these terms
Your use of the website is subject to these terms and the related policies. When you complete a purchase or submit a booking request after these terms have been made available to you, you acknowledge that you have reviewed them and agree that they apply to your transaction, without limiting any mandatory statutory rights available to you.
Eligibility
Purchases and bookings through the website are intended for persons who have the legal capacity required to enter into the relevant transaction. When placing an order or submitting a booking request, you are responsible for providing accurate and current information and for not using personal details or a payment method that you are not authorized to use.
Use of the website and its content
You may use the website and content made available to you lawfully for personal, non-commercial purposes. Using the website or purchasing a product or course does not transfer ownership of the website or its content to you and does not grant rights beyond the right to use what has been provided to you in accordance with the nature of the product or service and these terms.

The website may offer physical or digital products, including the ANA HIYA journal, the “Decode the Pattern | Reclaim Yourself” course, and a one-hour consultation booking service. Prices displayed in New Israeli Shekels (₪ / ILS) include VAT where applicable, and any additional charge applicable to an order, such as shipping where relevant, will be shown before the purchase is completed. A product or course purchase is confirmed after payment has been completed and the order accepted. Submitting a consultation request does not itself confirm an appointment; the request is subject to the coach’s approval, and consultation payment is always made outside the website after approval. If an accepted paid order cannot be fulfilled, the amount paid will be handled in accordance with applicable law and policy.
Delivery, cancellation, returns, and refunds
Digital products and the course are provided in the manner described at the time of purchase, while physical products are delivered using the agreed delivery or shipping method. Cancellation, return, and refund rights for all products, the course, and consultation requests or bookings are governed by our Cancellation, Returns & Refunds Policy, which forms part of these terms. That policy also applies to a consultation paid for outside the website where the booking request was made through the website. Cancelling a consultation does not automatically entitle you to a refund or a replacement appointment without charge, and a new appointment is treated as a new booking, unless applicable law requires otherwise or the coach expressly approves an exception.
Intellectual property
Intellectual property rights in the website and its content, including text, designs, images, educational materials, course content, journal content, and digital products, belong to Malak Manzour or to the relevant rights holders who have authorized their use, as applicable. Purchasing content does not transfer intellectual property ownership to you; it gives you the right to use the copy or access provided to you for personal use according to the nature of the product. Protected content may not be copied, published, distributed, sold, or made available to others without permission, except where permitted by law.
Third-party services and links

Governing law and disputes
